Legal Regulations Pertaining to the Bid Submission Deadline

The bid submission deadline is a pivotal moment in the contractor selection process, serving as the basis for determining the acceptance of bid documents, their validity, and the effective period of related documents. This section outlines key legal regulations regarding the bid submission deadline that bidders should be aware of.

1. Regulations Regarding the Minimum Time Period from Document Issuance to Bid Submission Deadline

According to Article 45 of the 2023 Bidding Law (amended by Clause 27, Article 1 of the Law amending the Bidding Law; the Law on Public-Private Partnership Investment; the Customs Law; the Value-Added Tax Law; the Export and Import Tax Law; the Investment Law; the Public Investment Law; the Law on Management and Use of Public Assets 2025), the period from the issuance of documents to the bid submission deadline is defined as the time allocated for contractors to prepare their bids. This period is calculated from the day the expression of interest, pre-qualification document, or bidding document is issued until the bid submission deadline.

During this time, any amendments to the expression of interest, pre-qualification document, or bidding document must be made prior to the bid submission deadline. Furthermore, these documents must be issued along with the call for expressions of interest, call for pre-qualification, or call for bids to ensure that contractors have adequate information to prepare their bids.

For other tasks within the contractor selection process, the contracting authority is responsible for determining the timeline based on the project’s or bidding package’s schedule.

2. Can the Contracting Authority Request Changes to Bid Documents After the Submission Deadline?

Post the bid submission deadline, the contracting authority is not permitted to request contractors to change the content of their submitted bid documents to uphold principles of fairness and transparency in the contractor selection process.

According to Clause 2, Article 65 of Decree 214/2025/ND-CP, the issuance, amendment, and clarification of bidding documents must comply with the stipulations in Clause 2, Article 28 of this Decree. For some simple or urgent consulting contracts, the law requires that any amendments to the bidding documents must be made at least three working days before the bid submission deadline.

3. How Long Before the Bid Submission Deadline Must Amendment Notices Be Sent to Ensure Legality?

Under Clause 2, Article 65 of Decree 214/2025/ND-CP (referencing the provisions on amending bidding documents), amendments must be executed before the bid submission deadline, ensuring that contractors have sufficient time to adjust their bid documents accordingly.

For specific cases, such as straightforward consulting contracts or urgent consulting contracts, the law stipulates that the amendment notice must be issued at least three working days prior to the bid submission deadline.

In practice, if amendments to the bidding documents are issued too close to the bid submission deadline, leaving contractors insufficient time to prepare or adjust their bids, the contracting authority must extend the submission deadline to uphold legality and adhere to principles of competition and transparency in the bidding process.

In conclusion, understanding the legal framework surrounding the bid submission deadline is essential for contractors to navigate the bidding process effectively. Compliance with the established timelines and regulations not only safeguards the integrity of the bidding process but also ensures that all participants have a fair opportunity to compete, thereby enhancing overall transparency in public procurement.
