Pursuant to Article 117 of Decree No. 125/2024/ND-CP, the procedures for issuance of the Certificate of Registration for overseas study consultancy services are prescribed as follows:
[1] Competent authority
The Director of the Department of Education and Training shall decide on the issuance of the Certificate of Registration for overseas study consultancy services.
[2] Application dossier
The dossier shall include:
- An application for issuance of the Certificate of Registration for overseas study consultancy services (using Form No. 07 in Appendix IV promulgated together with Decree No. 125/2024/ND-CP);
- A copy of the Enterprise Registration Certificate, the establishment decision, or the Investment Registration Certificate;
- A copy of legal documents evidencing the right to use land, ownership of a house, or a lease agreement for the premises of the organization providing overseas study consultancy services.
[3] Order and procedures
- The organization specified in Clause 1, Article 115 of Decree No. 125/2024/ND-CP shall submit one (01) set of the dossier prescribed in Clause 2, Article 117 of Decree No. 125/2024/ND-CP via the online public service portal, by postal service, or directly to the Department of Education and Training of the locality where the overseas study consultancy services are to be carried out;
- Within fifteen (15) days from the date of receipt of a complete and valid dossier, the Department of Education and Training shall conduct an appraisal and prepare an appraisal report to assess compliance with the conditions prescribed in Article 116 of Decree No. 125/2024/ND-CP;
- Within five (05) working days from the date of issuance of the appraisal report, if all conditions are satisfied, the Director of the Department of Education and Training shall issue the Certificate of Registration for overseas study consultancy services; if the conditions are not fully satisfied, the Department shall notify the applicant organization in writing and clearly state the reasons.
The Certificate of Registration for overseas study consultancy services (using Form No. 09 in Appendix IV promulgated together with Decree No. 125/2024/ND-CP) shall be publicly disclosed through mass media.
The Certificate of Registration for overseas study consultancy services shall have a validity period of no more than five (05) years, may be renewed, and each renewal shall not exceed five (05) years. The renewal of the Certificate of Registration for overseas study consultancy services must be carried out within six (06) months prior to its expiry date.
[4] Amendment, supplementation, and renewal during operation
During the course of operation, an organization providing overseas study consultancy services may request the Department of Education and Training to amend, supplement, or renew the Certificate of Registration for overseas study consultancy services. The dossier and procedures for amendment, supplementation, and renewal of the Certificate of Registration for overseas study consultancy services shall be implemented in accordance with Clauses 2 and 3, Article 117 of Decree No. 125/2024/ND-CP.
