In recent years, the issue of animal cruelty, particularly toward pets such as dogs and cats, has drawn increasing public concern in Vietnam. Viral videos of abuse or disturbing stories about neglect have sparked debates over whether Vietnamese law provides adequate protection for animals. This article provides a legal perspective on the question: Is harming or abusing pets a violation of Vietnamese law?
1. Vietnamese Law and Animal Welfare: An Emerging Framework
Vietnam does not yet have a comprehensive “Animal Welfare Law” like some countries, but various legal instruments prohibit acts of cruelty toward animals, particularly in the context of public order, veterinary care, environmental protection, and criminal justice.
Some relevant legal bases include:
- The Penal Code 2015 (amended 2017)
- The Law on Animal Health 2015
- The Law on Environmental Protection 2020
- Decree No. 14/2021/NĐ-CP (regulating administrative penalties in the field of livestock)
Although these regulations are fragmented, they provide the legal foundation for punishing certain forms of animal abuse, especially when such conduct causes harm to the community or violates animal disease control rules.
2. Criminal Sanctions: When Does Abuse Become a Crime?
Under Article 331 of the Penal Code (“Abusing democratic freedoms to infringe upon the interests of the State, lawful rights and interests of organizations and/or citizens”), public dissemination of violent, disturbing content involving animal torture may be prosecuted, particularly if it causes social unrest.
More directly, Article 318 of the Penal Code prohibits causing public disorder. In practice, violent acts against pets committed in public, especially in front of witnesses or shared on social media, may trigger this offense.
However, there is no specific article in the Penal Code that directly criminalizes individual acts of cruelty toward pets unless they overlap with public order or property rights (e.g., killing someone else’s pet).
3. Administrative Sanctions: Where the Law is Clearer
While the Penal Code may not always apply, administrative law provides clearer tools to penalize pet cruelty.
Decree No. 14/2021/NĐ-CP stipulates fines for:
- Failing to provide food, water, and shelter for livestock and pets;
- Beating, torturing or killing animals in a cruel manner;
- Using pets for fighting or other harmful entertainment.
Fines can range from 1 million to 3 million VND (approximately $40–130 USD), and may be higher for repeat or aggravated acts. While modest in amount, these sanctions reflect growing legal recognition of animal welfare in Vietnam.
4. Special Cases: Disease Control and Consumption
Vietnam still allows the slaughter and consumption of dogs and cats in certain areas, which remains controversial. However, this is regulated under animal disease prevention laws, not general animal protection.
For instance, illegal slaughter, sale, or transport of pets without veterinary supervision during an epidemic period may lead to both administrative and criminal sanctions under the Law on Animal Health and related decrees.
Conclusion
While Vietnam currently lacks a unified animal protection law, various criminal, administrative, and regulatory provisions can be used to penalize cruelty toward pets, especially in cases involving public disorder, improper treatment, or health risks. The trend is moving toward greater protection and awareness, but for now, the legal framework remains piecemeal and dependent on the specific circumstances of each case.
For pet owners, animal rights advocates, and local authorities alike, understanding these legal tools is essential to ensure responsible behavior and push for more humane treatment of animals in Vietnam.
