Procedures for Registration of a Household Business

1. Application Dossier

Pursuant to Clause 2 Article 99 of Decree No. 168/2025/ND-CP, the application dossier for the establishment of a household business includes:

  • An Application for Household Business Registration (in accordance with Form No. 1 promulgated together with Appendix II of Circular No. 68/2025/TT-BTC);
  • A copy of the written authorization from household family members authorizing one member to act as the head of the household business, in cases where the household business is registered by multiple family members.

2. Place of Submission

  • In case of direct submission: The applicant or the household business shall submit the application dossier to the commune-level business registration authority where the head office of the household business is located.
  • In case of online submission: The applicant shall declare information, upload electronic documents, and use a digital signature to authenticate the household business registration dossier in accordance with the procedures prescribed on the household business registration information system.
    The commune-level business registration authority shall issue the receipt and return the result of the registration procedure to the applicant via the electronic system.

3. Processing Time

Pursuant to Clause 3 Article 99 of Decree No. 168/2025/ND-CP, within three (03) working days from the date of receipt of a complete and valid application dossier, the commune-level business registration authority shall issue the Certificate of Household Business Registration.

In the event that the dossier is invalid, the competent authority must notify the applicant or the person establishing the household business in writing, clearly stating the reasons and specifying any required amendments or supplements (if any).

4. Household Business Registration Fee

The specific registration fee shall be determined by the People’s Council of the relevant province (pursuant to Article 5.2.g of Circular No. 85/2019/TT-BTC).

The applicant shall pay the household business registration fee at the time of submitting the application dossier. The fee may be paid directly at the dossier-receiving division at the commune level, transferred to the account of the commune-level business registration authority, or paid via online payment services on the National Public Service Portal.

Note: The household business registration fee is non-refundable in cases where the household business is not granted a Certificate of Household Business Registration.

5. Conditions for Household Business Registration

Pursuant to Clause 2 Article 85 of Decree No. 168/2025/ND-CP, a household business shall be granted a Certificate of Household Business Registration when all of the following conditions are satisfied:

  • The registered business lines are not prohibited from investment and business;
  • The name of the household business is established in compliance with the regulations set out in Section 1.3;
  • A complete and valid registration dossier is submitted;
  • The registration fee is fully paid in accordance with applicable regulations.

With respect to online household business registration dossiers, Article 112 of Decree No. 168/2025/ND-CP provides that such dossiers shall be accepted only when all of the following requirements are met:

  • All required documents are fully prepared, with contents duly declared as prescribed for paper-based dossiers and presented in electronic form;
  • The titles of electronic documents correspond to the names of the respective documents in the paper-based dossier;
  • All registration information declared on the household business registration information system is complete and accurate, consistent with the contents of the submitted dossier;
  • Contact information, including telephone number and email address of the applicant, is duly declared on the National Business Registration Portal;
  • The dossier is digitally signed by the head of the household business or by the duly authorized person. In case of authorization, the electronic dossier must include the relevant authorization documents specified in Section 1.7, presented in electronic form.

The time limit for amending or supplementing an online household business registration dossier is sixty (60) days from the date on which the commune-level business registration authority issues a notice requesting such amendment or supplementation.

Note: Upon expiry of the above time limit, if the household business fails to submit the amended or supplemented dossier, the registration dossier shall become invalid and shall be cancelled by the commune-level business registration authority in accordance with the procedures prescribed on the household business registration information system.
